Une convention CNSA-FEPEM-Etat pour accompagner les particuliers-employeurs en situation de perte d'autonomie.

Laurent Vachey, directeur de la CNSA et Marie-Béatrice Levaux, présidente de la Fédération des particuliers employeurs de France (Fepem) ont présenté le 1er juillet 2009 les modalités du partenariat liant les deux institutions.

Cette convention, conclue dans le cadre de la politique de soutien à la modernisation, à la structuration et à la professionnalisation des services d’aide et d’accompagnement à domicile des personnes âgées et des personnes handicapées développée par l’État et la CNSA, s’inscrit dans le cadre des objectifs du plan des métiers au service des personnes handicapées et des personnes âgées dépendantes lancé par le secrétariat d’État à la Solidarité en février 2008.

La CNSA versera 1 201 570 € sur 3 an à la Fepem qui s’engage ainsi à :

• Acquérir une meilleure connaissance des particuliers-employeurs en situation de perte d’autonomie, de leurs besoins et attentes, ainsi que des relations qu’ils entre-tiennent avec leurs salariés, grâce à des enquêtes pilotées par l’Observatoire Fepem mis en place en 2007. L’objectif est de leur proposer, à leur domicile, un accompagnement adapté à leur situation particulière.

• Sécuriser cet accompagnement à travers un mandat de qualité, en apportant aux structures intervenant en mode mandataire, les outils et informations nécessaires à la mise en place d’un cadre professionnel sécurisé, au service du projet de vie de la personne ayant fait le choix de rester à domicile (label de qualité).

• Concevoir, mettre en oeuvre et promouvoir une politique innovante des ressources humaines adaptée au secteur des particuliers-employeurs en situation de perte d’autonomie pour mettre en adéquation les compétences requises aux besoins exprimés et implicites.

• Valoriser les dispositifs de formation dédiés, auprès d’un public élargi (salariés, particuliers-employeurs, structures mandataires, institutionnels) grâce à un kit d’informations.

• Diversifier les moyens de professionnalisation, notamment par des formations multimédia interactives, des modules spécifiques sur l’accompagnement de la dépendance ou la création de communauté de professionnels (Relais Assistants de Vie).

Marie-Béatrice Levaux, Présidente de la Fepem, commente : « La finalisation de cette conven-tion nationale est une reconnaissance et une légitimation de l’accompagnement par la Fepem des personnes en perte d’autonomie. Elle nous engage à améliorer nos dispositifs et à les rendre plus lisibles encore pour toutes les personnes qui emploient à leur domicile. Elle ren-force le libre choix des personnes âgées et des personnes en situation de handicap et vise à mieux encadrer la mise en relation entre un employeur en perte d’autonomie et son futur salarié ».

Il s’agit de la quatrième convention que la CNSA et l’État signent avec une fédération nationale du secteur de l’aide à domicile. Les précédentes l’ont été avec UNA¹, ADMR² et ADESSA. Un partenariat avec l’UNCCAS³ est également en cours de finalisation.

La contractualisation avec la Fepem se justifie aisément puisque le modèle du particulier-employeur est très présent dans le maintien à domicile des personnes en situation de perte d’autonomie. 36% des heures effectuées au domicile des personnes âgées de 70 ans le sont dans le cadre de l’emploi direct et 18% via des organismes mandataires. Et, sur le dernier trimestre 2007, 188 000 particuliers-employeurs percevaient l’allocation personnalisée d’autonomie, soit environ 28 % des bénéficiaires de l’APA à domicile. L’emploi direct est éga-lement utilisé par une proportion importante de personnes handicapées bénéficiaires de la prestation de compensation du handicap (PCH) ou de l’allocation compensatrice pour tierce personne (ACTP) lorsqu’elles choisissent de recourir à une aide professionnelle.
